Jenny Konkin Congratulations

Congratulations to Jenny Konkin a small Vancouver slumlord.

Jenny Konkin is still in violation of a court order to maintain her business to provincial building code standards issued in November 2011 as a result of not providing heat to the tenants of the building.

Why heat the building when the windows are open all winter?

Why do slumlords like Jenny Konkin get away with flouting the law?

I now reside in a modern senior complex.

The building has heat. Individual thermostats. En-suite bathrooms. An ocean view.

All management staff have been professionally trained to provincial standards. There is a licensed kitchen. There is a kitchen manager and chefs; all of whom have passed the rigorous training demanded by provincial law. The sanitary enginners are all certified by the city and clean hours daily.

There are no vermin of any species.

Thank you for breaking the law (see below).

Thank you for paying me hundreds of dollars in court ordered fines (see below).

Starting at the bottom of the barrel where all the scum sticks: This slumlord, this Ms. Jenny Konkin (no photo)(and her brother).

This Ms. Konkin has learned to systematically victimize the poor tenants who provide her wealth. (see: a photo array)

This Ms. Konkin has learned to defraud the Provincial Government of British Columbia; to steal tax dollars with impunity.

This Ms. Konkin has learned how to commit perjury.

This Ms. Konkin has been in contempt of court for 671 days to date.

All of this in thirty short years. Quite a comprehensive education.

The real reason for the aggrandizement of this slumlord is as follows:

This slumlord, this Ms. Jenny Konkin has begun a (sic) charity supposedly for the poor. This Ms. Jenny Konkin knows how to victimize the poor. This Ms. Jenny Konkin knows how commit fraud and steal. This Ms. Jenny Konkin knows how to lie and is willing to commit perjury.

Is this slumlord, this Ms. Jenny Konkin the type of person you would trust with charitable funds? How much more could this slumlord steal?

Is a Ms. Jenny Konkin small Convicted Vancouver Slumlord a Media Bully?

There is an implicit trust between the media and the public. This trust is the guarantee that the media will publish the facts. Ethics 101, the journalism schools will confirm. This trust means that the media will not publish speculation. This trust means that the media will not publish lies.

Occasionally an interviewee may not tell the truth, withhold information. The journalism schools can confirm that the first lesson in responsible reporting is to always check the facts, to take nothing on faith. This results in ethical journalism, journalism with integrity.

On 15 September 2013 The Pacific Newspaper Group (under The Province banner) published a feel good story about this Ms. Jenny Konkin. Buried at the end of the article is the plug for the (sic) charity. This is an obvious ploy but the fact that the facts were not printed was stunning.

I informed the Pacific Newspaper Group of the facts that same day. (see: Is This Good Journalism?) I informed the Pacific Newspaper Group in three more letters over another two days.

Any responsible media outlet, with ethics, would check the facts. Any responsible media outlet would, if the facts merited it, print a retraction and a public apology. Responsibility is another part of the implicit trust and ethics upon which responsible journalism is founded. (query journalism schools again)

The Pacific Newspaper Group chose ignore and to suppress the facts. The Pacific Newspaper Group (under The Province banner) chose to publish lies.

By not doing the ethical thing the Pacific Newspaper Group becomes complicit in the criminal activities of this Ms. Jenny Konkin. They obviously support her slumlord activities, victimizing the poor tenants, stealing tax dollars and committing perjury.

One must ask if the article was purchased..

One must ask if the same lack of ethics and integrity extends to the rest of the Pacific Newspaper Group: The National Post, The Edmonton Journal, The Calgary Herald, The Winnipeg Free Press, The Vancouver Sun. Do all of these media outlets aid and abet slumlords, suppress facts and publish lies?

The complicity with this slumlord, this Ms. Jenny Konkin at the Pacific Newspaper Group includes: Kent Spencer (reporter), ------ (faith editor), Paul Chapman (editor-in-Chief), Mr. Gordon Fisher (publisher) and the rest of the Pacific Newspaper Group board of directors. Not one of you have shown ethics nor integrity in this.

Shame on you. Shame on all of you.

Vancouver Metro News (floating microscopic masthead) had the facts on 18 September 2013. On 25 September 2013 this 'media' outlet chose to publish a possibly well researched feel good article on the front page. Not one relevant fact was published. This slumlord, this Ms. Jenny Konkin's (sic) charity was featured in a box with banner. Another obvious ploy.

By not publishing a single fact Vancouver Metro News printed lies by omission. The maybe-no-one-will-know-I-was-bad method of printing actual lies.

One must ask if the article was purchased. Does the entire Metro Group aid and abet slumlords, suppress facts and print lies?

The 'mast head' is impossible to read. You find out who to blame. None the less.

Shame on you. Shame on all of you.

I published the story about this slumlord, this Ms. Jenny Konkin here (zedzzhedsezz: world wide scoop) on 18 September 2013. I sent the facts to you. From Victoria to St. John's. Some media outlets make contact difficult. I had hoped to find some integrity in journalism. (query journalism schools for the meaning of integrity) Surely one media outlet would report the truth.

In July 2012, ten months after my initial contact, CBC Go Public Ms. Kathy Tomlinson contacted me stating that the CBC would finally go public and broadcast the story. The next contact was to inform me that Go Public was after a different slumlord. Why?

The facts are public record. Not one fact was printed. Not one query regarding the facts. (one volunteer radio outlet did admire the detail in: Is This Good Journalism?)

Silence.

Is this the media equivalent of the 'thin blue line'? Were reporters frightened to do their job? Were the facts being suppressed by editors and owners? (see: Is a Ms. Jenny Konkin small Vancouver Slumlord a Media Bully?)

Silence is complicity.

Not one of you did your job. How can the public respect anything you print or broadcast after this?

Shame on you. Shame on all of you.

How does a slumlord with the above record manage to register a (sic) charity?

In October 2011 I met a worker at the Dockside Welfare Office regarding illegal rooms..

In October 2011 I called the tax hot line regarding the illegal restaurant.

The Honorable Christy Clark, Premier of British Columbia received most of the evidence on October 7, 2011. A promised form never delivered. (no promised investigation – obvious ploy)

Why?

The Honorable Adrian Dix, Leader of the Loyal Provincial Opposition, the Honorable Stephanie Cadieux, Minister of Social Development received most of the evidence the same day. (no reply)

Why?

The Honorable Jenny Kwan was contacted in early 2012 with all of the evidence. I received the brushoff.

Through the Honorable Ms. Kwan I received a letter on 4 July 2012. Serendipity had placed all of the evidence on the exact desk for which it was meant. The Honorable Stephanie Cadiuex, Cabinet Minister for Social Development instructed me to go to the back of the line.

Why?


The Honorable Prime Minister of Canada/The Honorable Leader of the Opposition Party of Canada/The Honorable Leader of the Bloc Quebecois/ The Honorable Leader of The New Democratic Party:

Slumlords are universal. Slumlords are in every village, town and city in every consituency in Canada. Slumlords feed on the poor. Slumlords are not nice people.

Who is protecting this slumlord? Why?

Is This Good Journalism?



A Ms. Jenny Konkin was featured in a full page story (The Moral Question written by Kent Spencer) with a very large photo in The Province on 15 September 2013. The story was about her time as a missionary and her plans in Vancouver. The only parts relevant are: “He (god) was protecting little old me. My purpose on this Earth isn't finished yet” (Ms. Konkin): “... the Avalon has always been operated in ways that are sensitive to tenant's needs” (Mr. Spencer): “... which is dedicated to improving residents lives” (Mr. Spencer): “People should have a place they feel safe to come home to.” (Ms. Konkin)

The facts tell a different story.

Ms. Konkin, by making her statements, has made herself a public figure. The Province was used as her vehicle to aggrandize herself, putting her views, her hotel and her business practices into public record. This means that she is open to public scrutiny. The job of the media.

By noon (15/09/13) I sent the facts, all on public record, to the news desk at The Province. The Province and it's editorial team had been duped and it was incumbent upon them to retract and publicly apologize. I received no reply. The next day (16/09/13) I sent the same facts to the attention of the Faith Editor. There was no answer. Later that day I sent the same facts to the attention of the Editor-in-Chief and the Faith Editor. I received no reply. The following day (17/09/13)I sent the same facts to the attention of the Publisher, the Editor-in-Chief and the Faith Editor. I received no reply.

The silence was crushing. Did no one read the Letters to the Editor? I began to wonder why there was no reply, to wonder how it came about that the article was even written? Who made the initial contact, the publication or Ms. Konkin? Was there no reply because the subject of the article (Ms. Konkin) in some sway over a staff member to have this written? Flatly, was it paid for? Has there been no reply because it is political? Do any of these questions answer why no background check was done? Does this mean that anyone can approach The Province and have anything they say printed as if it is fact?

I was being a gentleman. I discovered a gross error in the article and I gave the publisher and his staff more than ample time, days, to check the facts, respond and investigate. But news is timely. And so the reputation of The Province is another Konkin victim. The Province has chosen to remain silent but I have not.

Dear Editor:

I read the article on Ms. Jenny Konkin in your Faith section (15/09/13). As this article appears to be self-aggrandizement the facts need to be made known and as a respected member of the media community it should have been incumbent upon the reporter and editor to have all of the facts on hand before committing to publishing.

Let's begin with the Silver and Avalon Hotel where I was unfortunately a resident/victim from April 2011 to January 2012. The Silver and Avalon Hotel is infested with rats, mice, cockroaches and bedbugs. When a tenant discovers bedbugs the mattress is hauled out into the hallways, usually crowded with broken furniture, televisions and appliances; all of this blocking the very few emergency exits. These infested mattresses, bedding, et al can be left there for weeks. This, of course, allows the bugs to trundle off and re-infest any and all rooms in the hotel. The call to pest control is at the whim of Ms. Konkin. The garbage containers have no lids making them a feeding ground for the rodents. The toilets and showers are not clean.

September to October 2011 was very cold with overnight temperatures from12 degrees C and dropping into single digits. As the 'management' team (Ms. Konkin and Josh Konkin) is only there two or three days a week over the lunch hour I had to wait days to request that the heat be turned on and for my room to be fumigated for the against the bedbug infestation and to have a bed frame provided because after the first, not the second infestation, now the fourth (nb: correction), the mattress did not fit the original frame and I was sleeping on the floor and to replace missing windows in hopes of some heat being retained. Ms. Konkin's response to my request to have the heat turned on (for the benefit of the other 85 poor tenants/victims as well) was: “I will turn the heat on when I think it is cold.” Rather a cold and heartless response from the woman you describe in your article. My response was to go to the Tenant Review Board for satisfaction. Ms. Konkin did not deign to appear at the hearing.

In November the Tenant Review Board ruled in my favour, File # 782145. The court determined that heat was being withheld from the the tenants and Ms. Konkin was found guilty ordered to pay $200 for failing to provide heat. Ms. Konkin was found guilty of failing to maintain her building to provincial codes. Ms. Konkin was ordered to immediately replace the nine missing windows at the rear of the building. Ms. Konkin was found guilty of not ridding her building of vermin. Ms. Konkin was ordered to pay $2.50 per day each for both the missing windows and fumigation until completed. The fines were to be withheld by Social Services as per the court order as this would be the only way to collect. Ms Konkin was ordered to replace the bed frame. Of all of these orders the only compliance was replacing the bed frame (free). The room was never fumigated. The heat was not turned on on a continual daily basis until the middle of December. Today I went to check and the windows, ordered immediately replaced in November 2011are still plywood. Ms Konkin apparently has no respect for the laws of the land nor the orders of the court.

The Konkin response to this was to hand me an eviction notice. Reasons stated: theft of hotel property and threatening tenants and Ms. Konkin. This time she appeared for the hearing. The court dismissed the statements of theft and threatening. In other words the court deemed them: lies. The eviction notice carried no weight. Ms Konkin was defeated again in a court of law.

There is always more. After receiving the eviction notice I filed again with the Tenant Review Board File#784895. Then I looked deeper. The first room I occupied at the Silver and Avalon Hotel was: R2. R1-R4 have a separate entrance from the Avalon. None of the four rooms had windows. There was neither a functioning toilet or shower. For this 'room' Ms. Konkin charged Social Services $375. After a discussion with City Inspector Becky Innes I learned that Ms. Innes and Vancouver Fire Prevention Inspector Chris Short deemed this area “not acceptable for living accommodations” on 3 October 2011. In other words the room I originally occupied plus three others were illegal. How many months and years had Ms. Konkin been charging Social Services for illegal rooms? $375x4x12=$18,000 per annum. Has the provincial government recovered this money? Does the provincial government know how it spent this money?

There was also an illegal restaurant on site. I called Gurinder Saini to have Coastal Health inspect it. Now if the restaurant was illegal the question is: were taxes collected or paid? If not why?

The floors were professionally cleaned once while I was there by order of City Inspector Becky Innes.

In July (nb: correction) of 2011 many complaints were registered with the front desk regarding a stench on the 3rd floor. These complaints were ignored. Ignored until the police were called by a tenant to have the door of the room 324 emanating the smell broken into. A decomposing maggot infested corpse was found. In Ms. Konkin's determination to do nothing about complaints this tenant who died was treated extremely inhumanely. (Check with the coroner for details.)

Ms. Konkin then did not want to repay my damage deposit. She claimed I left no forwarding address. This is another lie. I left the address with a front desk employee, Mr. Ernie Humpfries. (All of the hotel employees are on assistance, is this some kind of welfare scam?) This began a third claim to the Tenant Review Board File # 787554. Ms. Konkin only capitulated when I sent the Review Board the evidence from the City Inspector and Coastal Health. She paid the damage deposit plus the daily fine for not complying with the original court order. In order to suppress the facts of illegal rooms and an illegal restaurant being placed into evidence with the court Ms Konkin by paying the fine admitted non-compliance with the court order and was defeated yet again in a court of law.

Did Ms. Konkin inform you about any of the above facts? Did the reporter look farther than Ms. Konkin's statements, make any background checks?

In hopes of bringing these facts to light in 2011-12 I contacted the Premier, the Opposition Leader, the Housing Minister and local MLA. I contacted Go Public at CBC, The Province, The Sun and The Courier. The politicians sent me form letters. The media did not deem it news. Now that your publication has aggrandized this woman is this not now news? Are there not criminal acts listed above? How much of what you published is negated by verifiable facts?

The moral question.

This is a story of possible criminal negligence, health hazards, exploitation, tax fraud, lack of government oversight, and greed.

I am on welfare.  I live in the Silver & Avalon Hotel at 165 West Pender, Vancouver.  The residents are mostly drug addicts, some have mental illnesses, some are in poor health and some are elderly.  Many have lived there for years and would not choose to rock the boat by trying to get decent living conditions for fear of being turned out.  There are stipulated laws regarding the exploitation and I believe that they are being broken.

The building has no heat.  Complaining to the management got the answer:  "I will turn it on when it is cold."  It has been cold for 2 weeks.  It was very cold last night.  But turning on the heat does not seem like it will help as there is a large window beside my room with no window pane.  Management told me today that the heat would be turned on today but that is a promise and many promises have been made and not kept.  Surely there is a law regarding heating a building.  I have searched but cannot find anything regarding Single Room Occupancy rules.  If this was an old folks home families would be up in arms and calling officials.  This is surely criminal.

The building is overrun with vermin:  bedbugs, cockroaches and mice.  I have been trying for 2 weeks to have my room sprayed for the 4th time in 5 months.  After the first spraying I have been sleeping on a mattress on the floor.  So after 4 months I am told that a bed frame will appear.  I was told that 3 days ago as well.  The spraying is usually carried out by tenants who have no training using dangerous chemicals.  In September a professional exterminator was called only because the city inspector ordered it.  There are open garbage cans on every floor, emptied only a few time per week, that are the feeding grounds for the mice and roaches.  In this situation does the law not call for sealed bins and very regular emptying?

In July, tenants complained of a stench coming from one room.  Two weeks later the room was opened and a rotting corpse was found.  This is inhumane to say the least.  And it is definitely a health hazard.  Today a professional team of cleaners has arrived, to clean that room it must be assumed.

In the room next to me there is a man who obviously has mental problems.  His room is filled with garbage, breeding mice.  But this is also a fire hazard.  The management is aware of this.

The hallways are repositories for broken furniture, appliances, and bedding that has been tossed due to bedbugs.  This mess can remain there for weeks.

The gross income for the hotel is $387,000 per annum ($375x86x12).  It appears that as little money as possible is being spent on repairs and upkeep.  Where does this profit go?  How do they manage to not have it all taken in taxes.  I believe that non-existent repairs are being claimed on the taxes.

Why does the government not oversee the SRO hotels in Vancouver?  Is there no one to protect the poor from exploitation by slum landlords?

Is there any way your investigative team can expose this activity to help the 86 residents?

I have spoken to Ms Uda with Go Public who is investigating.

Two days ago I asked again when the heat would be turned on.  I was told by the management:  "Today."  The heat is not on. Is it possible that this in not the first time the heat has been held back.  There are records to check.  A three person crew has spent 2 days cleaning the floors perhaps due to a visit from the city inspector in September.

No one could believe that the situation at the Silver & Avalon Hotel is unique among SRO accommodation in Vancouver.  Could any party be said to support the poor while allowing these degrading living conditions?

What will be done to change this dilemma?

What of myself?  This will have consequences.  I am ill and await medical examination.  There are waiting lists for SRO accommodation and few charge the allotted $375 per month.  Will I be a part of the lottery for shelter beds and forced into the cold?

Chris Short (Vancouver Fire Prevention Inspector) and I went thru the vacant restaurant, ground floor and basement areas of the hotel on Oct.3/11. The restaurant was vacant and unoccupied. The Fire Inspector and I had lengthy conversation with the management that this area is not acceptable for living accommodations.

In terms of the issue of possible illegal room rentals: after giving it some thought, I suggest that the best solution might be for you to directly contact both the Solicitor-General and the Ministry of Social Development. It may be true that the RTB’s Dispute Resolution adjudicators would not have grounds to issue an order based on your complaints, as their ability to issue decisions is quite restricted under current laws to resolution of very specific issues. Therefore I would suggest reporting the allegations directly to the Minister responsible for issuing Income Assistance payments, as well as the Solicitor-General and the Minister responsible for housing, and requesting, as someone who was tenant on the premises, that they look into the circumstances. Further, you would be in the best position to outline the details of your situation. You could put forward your concern either by mail or by email, and please feel free to carbon copy my office so that I can stay informed on the issue.

Dear Peter: Thank you for your email. Jenny is away from the office today which is why I reply.

While the allegations that you put forward are concerning, it would be difficult to proceed without some more concrete evidence.

My suggestion is that, if you or another current or former tenant can bring forward some evidence of illegal activity, it would be really helpful to Jenny in taking some action or in highlighting the situation.

We are sensitive to the pressures that the most marginalized tenants face, and some firm evidence of wrongdoing would give us something better to go on.
